Man Charged with 2 DUIs Avoids Mandatory 2 Years in Prison

Situation: Client, a young a man, was charged with 2 DUIs, each a 3 rd Offense carrying a 1 year mandatory minimum prison sentence.

The first of the two offenses arose at the beginning of the Summer. Based on potential constitutional violations Attorney Curry identified related to the client's arrest, a tentative agreement was secured at the initial hearing for a guilty plea to a reduced charge, which would reduce the mandatory minimum prison sentence from 1 year to 10 days. 

Towards the end of the summer, the client obtained another DUI, which also carried a 1 year mandatory minimum prison sentence.  Attorney Curry had been aware the client was an Iraqi War veteran and  had suffered the tragic loss of his fiancĂ© in a car accident soon after she gave birth to their child and immediately prior to his deployment.  Consequently, it appeared that the client never had an adequate opportunity to grieve before being thrust into a stress of an overseas deployment.  It also appeared the client never received grievance counseling prior to or during his deployment or any form of evaluation or counseling upon his return.

Solution: Due to these circumstances, Attorney Curry directed and assisted the client in obtaining in-patient treatment.  Following his release from the in-patient facility, he was directed to a VA Hospital for a PTSD evaluation.

Since the client's treatment was integral to his long-term well-being, Attorney Curry had to juggle the 2 pending DUIs in an effort to maximize these treatment opportunities. 

Results:  Based on the remedial measures that were taken to allow the client to proactively address the underlying issues that led to the DUIs, the client was sentenced to house arrest on the final DUI thereby avoiding a total of 2 years in mandatory prison time.

These sentences were legal sentences and the result of a progressive defense strategy.  Attorney Curry took a series of de-humanizing events and charges and re-humanized his client through a meticulous approach that not only had a significant, beneficial impact on the cases but the client's life as a whole by restoring what was nearly lost.  Attorney Curry brings this long-term vision to each case he handles, as he realizes each client's journey does not end just because their criminal case does. 

Man Charged with Stabbing Avoids Jail

Situation:  Client, a young man, was charged with bringing a knife to a custody exchange that resulted in the mother of his child receiving a laceration on her hand. As a result of the nature of the charges and applicable deadly weapon enhancements, the client faced state prison time.

Solution:Attorney Curry developed a strategic approach to challenge the prosecution's case during the court process.

Results: The client was able to enter a guilty plea under a negotiated plea agreement that resulted in probation.

No Jail for Woman Charged with Burglary and Assault

Situation:Client, a young woman was charged with burglary and was facing state prison time. 

Solution: Attorney Curry took the time to get to know his client and understand the underlying basis for the client's conduct. 

Results:With this knowledge, Attorney Curry was able negotiate with the prosecution for a plea to amended charges that would allow the client to avoid state prison. 

However, there was no agreement concerning the actual sentence and the judge was still free to sentence the client to up to 10 months in county jail.  At the time of sentencing, Attorney Curry was able to adequately place the incident into context for the court and the client received a sentence of 1 year probation.

Reduced Charge for Man Facing Lengthy State Prison

Situation: A young man who had been battling drug addiction incurred multiple criminal charges and faced a lengthy state prison sentence. In one case, he was charged with Attempted Burglary when he was caught trying to break into a neighbor's home through a screened window.  In the second case, he was charged with assault while he was in a drug and alcohol induced state.  In the final case, the client was charged with DUI with drugs in his system subjecting him to mandatory jail time.

Solution: Strategic negotiations were directed towards the client's underlying issues and treatment.

Results : Attorney Curry negotiated a plea involving amended charges and the client received a minimum of 3 months in county jail followed by a period of county supervision.
